Ford Hit With Large Verdict In SUV Rollover Crash When Mother Seriously Injured

 

A single mother who was paralyzed in a rollover crash recovered more than $21 million from Ford Motor Co. In 2007, Cynthia Castillo was driving a 1997 Ford Explorer on the interstate in Riverside County when the tread separated on the left rear tire. This caused her to veer off road, roll several times and finally hit a tree. Castillo fractured her spine and was rendered a quadriplegic. She receives 24-hour nursing care that she'll need for the rest of her life. She and her young daughter currently live with Castillo's parents. Castillo claimed that the rear axle and placement of shock absorbers caused it to tramp and skate, which led to a loss of control as the rear tire detreaded. Her counsel claimed internal memos showed Ford was aware of this condition, but they were ignored by Ford management. The jury found Ford 91.5 percent liable, which reduced the $23.4 million award.

Parents of Student Killed In Rollover Car Accident Recover - Dallas, Texas

 

A jury ordered Hyundai Motor Co. to pay $810,000 to the parents of a college student killed in a rollover accident. In 2007, Sarah Goodner, 19, was a front-seat passenger in her sister's 2005 Hyundai Tucson sport utility vehicle when it veered off the road and rolled over. Goodner had been napping with her seat fully reclined when the forces of the accident caused her to slide out from under her lap belt. She was ejected out the rear window and killed. Goodner's parents blamed Hyundai, alleging design defects in the front passenger seat and SUV's restraint system contributed to their daughter's death. Hyundai argued that the Tucson had a five-star safety rating and met all applicable safety standards. The jury found Hyundai 45 percent, the driver 45 percent, and Goodner 10 percent liable. The $1.8 million award was reduced to reflect Hyundai's liability only.

Arlington Texas Girl Dies In Rollover Car Crash Due To Head Injury

 

A 13-year-old Arlington girl died Friday night in a rollover accident on State Highway 360 in Grand Prairie.

Kelsee Williams, an eighth-grader at Gunn Junior High School in Arlington, was in the back seat of a Chevrolet Suburban  when accident investigators say she apparently reached forward to change the radio station using the steering wheel controls. Police said the driver, 16-year-old Jaccob Washington, lost control of the northbound vehicle and flipped off the road in the 6400 block of South Highway 360 near the Grand Prairie-Mansfield border about 10 p.m.

Williams was taken to Methodist Mansfield Medical Center, where she died. The Tarrant County medical examiner ruled that she died of a skull fracture.

The driver and two other teenage passengers were not injured. Grand Prairie investigators said the four teens were not wearing seatbelts at the time of the crash.

Family Gets 8.5M for Fatal Rollover Crash Involving SUV

 

A family recovered $8.5 million after a jury found that defects in a sport utility vehicle's suspension system were partly to blame for a rollover that killed one occupant and seriously injured another. In July 2003, James Wiles was driving a 1996 Ford Explorer with his wife, Diane Wiles, 42, in the back seat. The truck's left rear tire lost its tread. The rear end of the truck then slid and Mr. Wiles lost control as he tried to steer off-road. The truck rolled over four times and Mrs. Wiles was ejected and killed while her husband was injured. The family blamed Ford Motor Co. and Michelin North America, alleging design and manufacturing defects in the tire and Explorer. The jury found in favor of the plaintiffs on the suspension claim against Ford. A tiremaker and auto servicing company also named as defendants were exonerated. The jury awarded $20 million, but it was reduced for Mr. Wiles' comparative negligence and Mrs. Wiles' failure to wear a seat belt.
