Her friends claimed bartenders continued to serve her beers even though she was "loud, a little obnoxious" and "off balance." She drank there until closing time at 2 a.m. Her blood alcohol level was 0.224. The plaintiff's toxicology expert testified that she consumed at least eight to nine beers and would have exhibited visible signs of intoxication. The jury found Schuenemann 49 percent liable, which reduced its $1.9 million award.

Bar Liable For Fatal Motorcyle Crash Caused By Drunk Driver - Dallas, Texas

 

A jury awarded $14.2 million to the family of a woman who was killed in a crash with a drunken driver pulling out of a bar's parking lot where he was celebrating his 21st birthday. George Elenbark was riding his motorcycle with his wife, Mary Elenbark, when they collided with a car driven by Steven Evans, who fled the scene. Mrs. Elenbark died a week after the accident. Mr. Elenbark sustained crush injuries to his leg, ankle and foot. His leg is grossly deformed with considerable muscle damage and continuing atrophy. Evans is serving four years in prison. The family claimed that Rack's Bar and Grill overserved Evans and then intentionally altered surveillance videos that showed how much Evans had been drinking that night. The bar was found 75 percent liable and Evans was found 25 percent liable.

Two Men Killed In Dallas Texas As A Result Of Drunk Driving Car Accident

 

Two men were killed this morning when a drunken driving suspect plowed through a bus shelter across from Parkland Memorial Hospital.

The men were apparently sleeping in the Dallas Area Rapid Transit stop shortly after 2 a.m. when the suspect's northbound pickup jumped a curb and leveled the structure, on Harry Hines Boulevard just south of Inwood Road.

Both victims, described only as homeless men in their 30s, died at the scene. They were not identified pending notification of family members.

The suspect was arrested after stumbling through a field sobriety test, witnesses said.  A Dallas police  report identified him as 50-year-old Julian Cadena Cerda.

He faces two counts of intoxication manslaughter and is being held at the Dallas County Jail.

Bar Responsible For Fatal Car Crash By Drunk Driver Who Killed A Man - Dallas, Texas

The family of a man killed by a drunken driver recovered $300,000 from a bar that allegedly overserved him. Plaintiff William Grieb, 34, had been pulled over by police when he stood on the side of the road between his car and the police car. A truck driven by Shane Gildersleeve collided with the police car. The police officer was able to jump out of the way, but Gried was fatally crushed between the two cars. Gildersleeve kept driving for another half-mile until police pulled him over. He had a blood alcohol level of 0.15 and four unopened beers in his truck. The truck driver and his employer settled for $1 million and the family went to trial against the Starting Gate Bar. Plaintiff's counsel argued that it served Gildersleeve 10 to 12 beers and sold him a six-pack to go. The jury found the bar 20 percent liable and the settling tortfeasors 80 percent liable, which reduced its $1.5 million award.

A former college student who sustained a severe brain injury in a collision with a drunken driver recovered $19.9 million. In 2007, Jacklyn Murphree, then 20, was driving in Decatur when Betty Ann Monroe drove through a section of road that was closed for construction and crashed into Murphree's car. She suffered a shearing brain injury. She is semi-conscious and capable of some movement, but cannot communicate and recovery is unlikely. In addition to blaming Monroe, who subsequently pleaded guilty to driving while intoxicated, Murphree's parents also sued construction contractor Site Concrete and subcontractor Austin Bridge & Road for failing to provide proper safety devices to prevent entrance to the work zone. The jury found Monroe 70 percent liable and Site Concrete and the state Department of Transportation, which was not a party to the suit, each 15 percent liable. Austin Bridge & Road was exonerated.
